1. Who this applies to, and how it fits with our other terms

These Restaurant Operator Terms apply to every Restaurant Operator, whether or not you subscribe to a paid plan. A Restaurant Operator is anyone who owns, operates or manages a restaurant, or who signs in to EatOutLog as a verified operator on a restaurant's behalf. Claiming a restaurant listing makes you a Restaurant Operator. These terms are an addendum to, not a replacement for, our general Terms of Service, which still applies to everything you do on EatOutLog as a user. Where these terms add something the general Terms of Service doesn't cover, both apply. Where they conflict, these terms control for anything specific to your role as a Restaurant Operator.

2. Claiming a restaurant

Claiming a restaurant means asserting that you're a Restaurant Operator of it: you own, operate or manage it, or you're authorized to act on the business's behalf. We review claim submissions, including any evidence you provide, before approving them. Submitting false or misleading evidence to claim a restaurant you're not authorized to represent is a violation of these terms and our general Terms of Service, and may result in the claim being denied and your account being suspended.

3. Paid subscriptions, cancellation and refunds

Insights, Promoted and the Data API are paid plans, billed through our payment processor (Stripe) for each restaurant you choose to cover. All of your plans are on one subscription, with one bill and one renewal date.

Renewal

A subscription renews automatically at the start of each billing period, monthly or annually depending on the plan you choose, and charges your payment method on file until you cancel. By subscribing, you authorize those charges.

Canceling

You can cancel anytime from Manage billing on the Billing page. Canceling stops all future charges. You keep full access through the end of the period you already paid for, and the subscription ends then.

Deleting your EatOutLog account, or your account being banned for violating these terms or our Terms of Service, cancels every subscription on it right away. Your restaurants become unclaimed and lose the plan's features at once, and the rest of the billing period isn't refunded (see the next section).

No refunds for unused time

We don't refund or credit the unused part of a billing period. If you cancel halfway through a month, you aren't charged for the next month, and you keep access for the rest of the month you paid for, but you don't get money back for it. The same applies to annual plans: canceling partway through the year stops the next annual charge, and you keep access until the year ends, but the remaining months aren't refunded. This applies whether you cancel or your account is terminated for violating these terms or our Terms of Service.

Changing your plan

Billing errors and exceptions

If you believe you were charged in error, such as a duplicate charge or a charge after you canceled, contact us and we'll look into it. We may refund charges that were our mistake.

Chargebacks

If you dispute a charge with your bank or card issuer instead of contacting us first, we may suspend the affected subscription while we investigate.

Price changes

If we change subscription pricing, we'll tell you before it applies to your next billing period. Continuing your subscription after that means you accept the new price. Canceling before your next billing date avoids it.

Your rights under the law

Nothing in this section limits any refund or cancellation right you have under applicable law that can't legally be waived.

4. Rating integrity: what you can't do

Ratings and check-ins on EatOutLog are meant to reflect what a real diner actually experienced. As a Restaurant Operator, you agree not to:

We may investigate unusual activity on a restaurant's ratings, including patterns that suggest coordinated or incentivized posting, whether or not we can prove your direct involvement.

5. Accuracy of restaurant information

You're responsible for the accuracy of any menu, hours, or other restaurant information you submit or update as a Restaurant Operator.

6. Showing EatOutLog data publicly

You can use the ratings, statistics and other data EatOutLog gives you about your own restaurant however you like inside your business, for example in staff meetings, internal reports or your own analytics tools. Internal use needs no attribution.

If you show EatOutLog data to the public, in any form and however you got it (from your dashboard, a screenshot, a data export or any other EatOutLog feature), you agree to:

Our attribution kit has logo files, wording and examples that follow this section.

If we find EatOutLog data shown publicly in a way that doesn't follow this section, we'll ask you to fix it first. Repeated or serious problems may lead to the steps in section 8.

7. Data API

If you subscribe to Data API access, you can create credentials that let software read your restaurant's EatOutLog statistics. Access is read-only and returns totals and averages only, never information that identifies an individual diner. By using it, you agree that:

8. Enforcement: suspension and termination

If you violate these terms, in addition to any action available to us under our general Terms of Service, we may:

If your account is banned, you may not claim any restaurant on EatOutLog for at least one year from the date of the ban, even if the ban is later lifted. This applies to any account that uses the same email address or device.

This doesn't affect diner-submitted check-ins and ratings for your restaurant, which remain on the platform as a factual record regardless of your account's status, consistent with Section 5 of our Terms of Service.

9. Changes to these terms

If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you.
